FSSolutions faxed Dr. Thalman several times to ask him to join its network of preferred medical providers and administer various employment screening and testing services to its clients. Thalman declined the invitation and instead invoked the Telephone Consumer Protection Act, 7 U.S.C. 227(b)(1)(C), to sue FSSolutions for sending him unsolicited advertisements.
