During the pendency of appeal, Congress passed and the President signed into law the Moving Ahead for Progress in the 21st Century Act, which authorized funding for highways and other transit programs, with partial funding to come from amendment of the definition of “manufacturer of tobacco products” to include retailers who make roll-your-own machines available to customers, thereby achieving the same result as the Ruling. The Sixth Circuit vacated and directed that the case be dismissed. The statutory amendment mooted the controversy and the Anti-Injunction Act precluded the court’s exercise of jurisdiction
