Cayce Clerk UNITED STATES OF AMERICA, Plaintiff-Appellee v. MARCO ANTONIO OVALLE-CASTILLO, Defendant-Appellant Appeal from the United States District Court for the Southern District of Texas USDC No. 7:12-CR-384-1 Before JONES, DENNIS, and HAYNES, Circuit Judges. PER CURIAM:* Marco Antonio Ovalle-Castillo appeals his 57-month sentence for having been found unlawfully in the United States following deportation. He contends that the district court plainly erred by imposing the 16-level crime of violence enhancement in U.S.S.G. § 2L1.2 based upon his prior conviction for burglary of a habitation with intent to commit theft, in violation of Texas Penal Code § 30.02(a)(1).
