Plaintiffs appealed a summary judgment in favor of the LWCC, which cross-appealed the denial of its motion to dismiss for want of subject-matter jurisdiction. Because the district court lacked subject-matter jurisdiction over the state claims plaintiffs brought against LWCC, the court need not decide whether the district court correctly determined that LWCC's decision to withhold consent on the settlement was a proper exercise of its power under the Longshore and Harbor Workers' Compensation Act, 33 U.S.C. 901-950. Accordingly, the court reversed summary judgment and rendered a judgment of dismissal for want of jurisdiction.
