UNPUBLISHED UNITED STATES COURT OF APPEALS FOR THE FOURTH CIRCUIT No. 21-1982 RUDOLPH BENJAMIN LAVARNE WHITEHURST, Plaintiff - Appellant, v. TERESA DELOATCH BRYANT, Defendant - Appellee. Appeal from the United States District Court for the Eastern District of North Carolina, at Greenville. Richard E. Myers, II, Chief District Judge. (4:20-cv-00179-M) Submitted: June 28, 2022 Decided: July 12, 2022 Before AGEE and WYNN, Circuit Judges, TRAXLER, Senior Circuit Judge. Affirmed by unpublished per curiam opinion. Rudolph Benjamin Lavarn Whitehurst, Appellant Pro Se. Christina Jansen Banfield, HARRIS, CREECH, WARD & BLACKERBY, New Bern, North Carolina, for Appellee. Unpublished opinions are not binding precedent in this circuit. PER CURIAM: Rudolph Whitehurst appeals the district court’s order dismissing his civil action without prejudice for lack of subject matter jurisdiction. We have reviewed the record and find no reversible error. Accordingly, we affirm for the reasons stated by the district court. Whitehurst v. Bryant, No. 4:20-cv-00179-M (E.D.N.C. Aug. 23, 2021). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process. AFFIRMED 2
