UNPUBLISHED UNITED STATES COURT OF APPEALS FOR THE FOURTH CIRCUIT No. 20-7634 RODERICK DEVON FROST, Petitioner - Appellant, v. R. HUGGINS, Respondent - Appellee. Appeal from the United States District Court for the Northern District of West Virginia, at Martinsburg. Gina M. Groh, Chief District Judge. (3:19-cv-00143-GMG-RWT) Submitted: March 23, 2021 Decided: March 29, 2021 Before THACKER, QUATTLEBAUM, and RUSHING, Circuit Judges. Dismissed by unpublished per curiam opinion. Roderick Devon Frost, Appellant Pro Se. Unpublished opinions are not binding precedent in this circuit. PER CURIAM: Roderick Devon Frost has filed a notice claiming to appeal the final judgment entered in his 28 U.S.C. § 2241 proceedings. This court may exercise jurisdiction only over final orders, 28 U.S.C. § 1291, and certain interlocutory and collateral orders, 28 U.S.C. § 1292; Fed. R. Civ. P. 54(b); Cohen v. Beneficial Indus. Loan Corp., 337 U.S. 541, 545-46 (1949). A review of the district court’s docket reveals that the court has yet to issue a final order related to Frost’s § 2241 petition. Accordingly, we deny Frost’s motion for summary judgment and dismiss the appeal for lack of jurisdiction. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before this court and argument would not aid the decisional process. DISMISSED 2
