While this appeal was pending, the New York Court of Appeals, in Freedom Mortgage Corp. v. Engel, 37 N.Y.3d 1 (2021), abrogated the proposition of Milone on which the district court relied. Therefore, this intervening decision undermined the reasoning of the district court. The court remanded for further proceedings.
