The Second Circuit denied a petition for review of the BIA's order of removal based on petitioner's conviction for an aggravated felony. The court held that petitioner's conviction for conspiracy in the second degree to commit a felony -- murder in the second degree in this case -- under New York law was an aggravated felony. The court applied the categorical approach and held that second degree murder is clearly an aggravated felony within the federal definition.
