Paloka v. Holder, No. 12-4987 (2d Cir. 2014)Annotate this Case
Petitioner, a native of Albania, petitioned for review of the BIA's dismissal of her application for asylum and other relief. At issue was whether "young Albanian women" or "young Albanian women between the ages of 15 and 25" qualify as a particular social group. The court concluded that it was necessary to remand to the BIA for a redetermination of whether petitioner has identified a cognizable social group in light of the BIA's recent clarifications in M-E-V-G- and W-G-R-. Accordingly, the court vacated the BIA's decision and remanded.
