The Eleventh Circuit affirmed the district court's dismissal of plaintiff's amended complaint because the Law Enforcement Officers Safety Act did not give rise to a federal right enforceable under 42 U.S.C. 1983. Plaintiff, formerly employed by the police department, filed suit against the city, seeking to have it issue her the type of identification card required by the Act. The Act allows a qualified retired law enforcement officer who is carrying the identification required by the Act to carry a concealed firearm, notwithstanding most State or local restrictions. The court held that no provision of 18 U.S.C. 926C compelled the state to provide Act-complaint identification and thus the Act did not confer such a right.
