Boyd v. United States, No. 11-15643 (11th Cir. 2014)Annotate this Case
Petitioner appealed the district court's denial of his fourth-in-time 28 U.S.C. 2255 motion to vacate, set aside, or correct his sentence. The court concluded that the district court erred in dismissing petitioner's fourth section 2255 motion as successive where petitioner's previous section 2255 motions did not render his fourth section 2255 motion successive. The court reversed and remanded for the district court to determine whether the instant motion was timely.
