US Court of Appeals for the Fourth Circuit - 993 F.2d 1537 (4th Cir. 1993) Submitted: March 29, 1993Decided: April 28, 1993

Appeal from the United States District Court for the District of Maryland, at Baltimore. William M. Nickerson, District Judge. (CA-92-2325-WN)

Raymond H. Kirby, Appellant Pro Se.

John Joseph Curran, Jr., Attorney General, Audrey J. S. Carrion, Office of the Attorney General of Maryland, Baltimore, Maryland, for Appellees.

D. Md.

AFFIRMED.

Before LUTTIG, Circuit Judge, and BUTZNER and CHAPMAN, Senior Circuit Judges.

PER CURIAM:

Raymond H. Kirby appeals from the district court's order denying relief under 42 U.S.C. § 1983 (1988). Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. Kirby v. Galley, No. CA-92-2325-WN (D. Md. Jan. 27, 1993).*  We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED

We grant Kirby's "Motion for Leave to Submit Affidavit" and have considered his affidavit in the course of this appeal
