After examining the briefs, this panel has determined unanimously that oral argument would not materially assist the determination of this appeal. See Fed. R. App. P. 34(a); 10th Cir.R. 34.1.9. Therefore, the case is ordered submitted without oral argument.

There is no allegation that the defendant was required to proceed to trial in his prison uniform,1  and in the absence of any such allegation, we AFFIRM for the reasons stated in the District Court's Order of February 28, 1991, including the Report and Recommendation of the United States Magistrate filed January 31, 1991.
