Annotate this Case
US Court of Appeals for the Fourth Circuit - 935 F.2d 1288 (4th Cir. 1991) Submitted May 2, 1991. Decided June 21, 1991

Appeal from the United States District Court for the Eastern District of Virginia, at Newport News. J. Calvitt Clarke, Jr., District Judge. (CR-87-42-NN)

Bernard J. Thomas, Jr., appellant pro se.

Robert Edward Bradenham, II, Assistant United States Attorney, Norfolk, Va., for appellee.

E.D. Va.

AFFIRMED.

Before DONALD RUSSELL and PHILLIPS, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

Bernard J. Thomas, Jr. appeals from the district court's order refusing to compel the government to disclose information requested by Thomas under the Freedom of Information Act. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Thomas, CR-87-42-NN (E.D. Va. Feb. 15, 1991). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED.
