Annotate this Case
U.S. Court of Appeals for the Ninth Circuit - 914 F.2d 262 (9th Cir. 1990)

No. 90-16086.

United States Court of Appeals, Ninth Circuit.

Before WALLACE, DAVID R. THOMPSON and FERNANDEZ, JJ.

MEMORANDUM**

James Comiskey appeals the district court's judgment holding him in civil contempt and ordering him incarcerated for refusing to testify before the grand jury. He contends that the government, by failing to keep him out of sight of grand jury witnesses and others, violated Fed. R. Crim. P. 6(e)'s secrecy requirement. We affirm for the reasons set forth in our opinion in In Re Grand Jury Proceedings (Lahey), No. 90-16085, slip op. ----, (9th Cir. September 20, 1990).

AFFIRMED.
