MEMORANDUM*** 

We affirm the district court on the basis of its decision. Like the district court, we conclude res judicata bars the Whitehorns' complaint. We also agree with the district court that the Whitehorns improperly served the appellees.

Because this appeal is frivolous, no petition for rehearing will be entertained. The Whitehorns are hereby advised that further litigation of the WFDR's sale will result in sanctions.

AFFIRMED.
