Annotate this Case
U.S. Court of Appeals for the Fourth Circuit - 878 F.2d 379 (4th Cir. 1989)

Submitted May 11, 1989. Decided June 21, 1989

Roy Edward Flowers, appellant pro se.

Thomas Drummond Bagwell, Office of the Attorney General of Virginia, for appellees.

Before K.K. HALL and PHILLIPS, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

Roy Edward Flowers seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. Flowers v. Muncy, C/A No. 88-445-R (E.D. Va. Dec. 30, 1988). We dispense with oral argument because the dispositive issues recently have been decided authoritatively.

DISMISSED.
