Unpublished Disposition, 875 F.2d 870 (9th Cir. 1989)

Annotate this Case
U.S. Court of Appeals for the Ninth Circuit - 875 F.2d 870 (9th Cir. 1989)

Harold C. BOROM, Petitioner-Appellant,v.Richard H. RISON, Warden, Respondent-Appellee.

No. 88-5546.

United States Court of Appeals, Ninth Circuit.

Submitted April 21, 1989.* Decided May 22, 1989.

Before KILKENNY, WIGGINS and NOONAN, Circuit Judges.

MEMORANDUM**

Harold Borom appeals pro se the district court's dismissal of his petition for a writ of habeas corpus under 28 USC Sec. 2241. Because this appeal presents a question of law and not of fact, we review de novo. See Roberts v. Corrothers, 812 F.2d 1173, 1178 (CA9 1987). We affirm.

Borom's argument that he is entitled to receive credit for 224 days of "extra good time" under 18 USC Sec. 4162 earned prior to his violating parole is without merit. Release on parole does not entitle an offender to a reduction in the overall length of his sentence, and credit for "good time" therefore is not carried forward to shorten a sentence following a parole violation. 28 CFR Secs. 2.35(b); 523.17(c); Raines v. United States Parole Comm'n, 829 F.2d 840, 844 (CA9 1987) (per curiam).

AFFIRMED.
