Unpublished Disposition, 865 F.2d 265 (9th Cir. 1988)

Annotate this Case
US Court of Appeals for the Ninth Circuit - 865 F.2d 265 (9th Cir. 1988)

UNITED STATES of America, Plaintiff-Appellee,v.Malcolm Thomas HARDY, aka Malcolm Raymond Lloyd, Defendant-Appellant.

No. 87-1371.

United States Court of Appeals, Ninth Circuit.

Argued and Submitted Nov. 10, 1988.Decided Dec. 15, 1988.

Before NELSON, REINHARDT and WIGGINS, Circuit Judges.

MEMORANDUM*

Appellant correctly concedes that the issues he raised on appeal have been resolved against him in U.S. v. Rewald, 835 F.2d 215, 216 (9th Cir. 1987). At oral argument counsel contended that the court's partial reliance in sentencing appellant on his record of convictions in England was somehow unlawful. This argument is wholly without merit.

AFFIRMED.
