Donald Ray Bass, Petitioner-appellant, v. R.m. Muncy, Warden, Respondent-appellee, 851 F.2d 356 (4th Cir. 1988)

Annotate this Case
US Court of Appeals for the Fourth Circuit - 851 F.2d 356 (4th Cir. 1988) Submitted: June 8, 1988. Decided: July 6, 1988

Elizabeth Harding Dashiell, Michael Morchower (Morchower, Luxton & Whaley), for appellant.

Robert Homer Anderson, III (Office of the Attorney General of Virginia), for appellee.

Before DONALD RUSSELL, WIDENER and SPROUSE, Circuit Judges.

PER CURIAM:

Donald Ray Bass seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. Bass v. Muncy, C/A No. 87-513-R (E.D. Va. Feb. 29, 1988). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

DISMISSED.
