James L. Breeden, Petitioner-appellant, v. E. L. Booker, Warden, Respondent-appellee, 838 F.2d 465 (4th Cir. 1988)Annotate this Case
Submitted Dec. 18, 1987. Decided Jan. 26, 1988
Marvin David Miller, for appellant.
Robert Homer Anderson, III, Frank Snead Ferguson, Eugene Paul Murphy, Office of Attorney General of Virginia, for appellee.
Before K.K. HALL, ERVIN, and CHAPMAN, Circuit Judges.
A review of the record and the district court's opinion discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the district court.
