Robert James Thayer, Ii, Petitioner-appellant, v. W. P. Rogers, Warden, Respondent-appellee, 826 F.2d 1061 (4th Cir. 1987)Annotate this Case
Submitted May 28, 1987. Decided August 6, 1987
Robert James Thayer, II, appellant pro se.
Robert B. Condon, Office of the Attorney General, for appellee.
Before SPROUSE, CHAPMAN and WILKINSON, Circuit Judges.
A review of the record and the district court's opinion discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. Thayer v. Rogers, C/A No. 86-497-AM (E.D. Va., March 23, 1987).
