This case has been referred to a panel of the court pursuant to Rule 9(a), Rules of the Sixth Circuit. Petitioner pled no contest in the state courts to three counts of rape. He was unsuccessful in the Court of Appeals and the Supreme Court of Ohio in his attempts to overturn the trial court's denial of a motion to suppress an alleged confession he had made to a police investigator. He also filed a post-conviction motion in the trial court alleging that his plea
