Calvin Hubbard, Petitioner-appellant, v. Warden, Maryland State Penitentiary, Respondent-appellee, 825 F.2d 407 (4th Cir. 1987)

Annotate this Case
U.S. Court of Appeals for the Fourth Circuit - 825 F.2d 407 (4th Cir. 1987)

Submitted May 29, 1987. Decided July 14, 1987

Calvin Hubbard, appellant pro se.

Stephanie Judith Lane-Weber, Assistant Attorney General, for appellee.

Before WIDENER, HALL and ERVIN, Circuit Judges.

PER CURIAM:

A review of the record and the district court's opinion discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. Hubbard v. Warden, C/A No. 86-259-H (D. Md., Feb. 18, 1987).

DISMISSED.
