ORDER

Appellant moves for appointment of counsel and to proceed in forma pauperis on appeal from the district court's dismissal of his petition for a writ of habeas corpus (28 U.S.C. § 2241). Upon consideration of the record and appellant's brief, this panel unanimously agrees that oral argument is not necessary. Rule 34(a), Federal Rules of Appellate Procedure.

The motion to proceed in forma pauperis is granted, the motion for appointment of counsel is denied and the judgment of the district court is affirmed pursuant to Rule 9(b) (5), Rules of the Sixth Circuit.
