Glen E. Smith, Petitioner-appellant, v. J.j. Clarke, Warden of the Petersburg Federal Correctionalinstitute; Mary Sue Terry, Attorney General Ofthe Commonwealth of Virginia,respondents-appellees, 812 F.2d 1402 (4th Cir. 1987)

Annotate this Case
US Court of Appeals for the Fourth Circuit - 812 F.2d 1402 (4th Cir. 1987) Submitted Dec. 31, 1986. Decided Feb. 23, 1987

Before PHILLIPS, MURNAGHAN and SPROUSE, Circuit Judges.

Glen E. Smith, appellant pro se.

Jacqueline G. Epps, Assistant Attorney General, for appellees.

PER CURIAM:

A review of the record and the district court's opinion accepting the magistrate's recommendation discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. Smith v. Clarke, C/A No. 86-42-N (E.D. Va., Sept. 15, 1986).

DISMISSED.
