ID No. 0706023751 Submitted: November 9, 2010 Decided: November 15, 2010 ORDER This 15th day of November 2010, the Court has considered the September 16, 2010 notice to show cause issued to the appellant, Lamere Williamson, for his failure to file the opening brief. In response to the notice, Williamson requested an extension of time to file the brief. By letter dated October 8, 2010, the Clerk granted Williamson an extension of time until November 8, 2010. The Clerk also advised Williamson that [t]he notice to show cause will be held in abeyance pending receipt of the opening brief, and that [i]f the opening brief is not filed by November 8, the Court will deem the dismissal of this appeal as unopposed. Williamson has not filed the opening brief. Williamson s failure to file the opening brief is deemed to be his consent to the dismissal of this appeal. NOW, THEREFORE, IT IS ORDERED, pursuant to Supreme Court Rules 3(b)(2) and 29(b), that the appeal is DISMISSED. BY THE COURT: /s/ Randy J. Holland Justice
