IN THE SUPREME COURT OF THE STATE OF DELAWARE MICHAEL ROBERTS, Defendant Below, Appellant, v. STATE OF DELAWARE, Plaintiff Below, Appellee. § § § § § § § § § § No. 75, 2009 Court Below--Superior Court of the State of Delaware in and for New Castle County Cr. ID Nos. 0609001737 0704016372 Submitted: July 31, 2009 Decided: October 30, 2009 Before STEELE, Chief Justice, HOLLAND and RIDGELY, Justices. ORDER This 30th day of October 2009, after careful consideration of the parties briefs and the Superior Court record, we find it manifest that the judgment of the Superior Court should be affirmed on the basis of the Court s well-reasoned memorandum opinion dated January 20, 2009. The Superior Court did not err when concluding that appellant s motion for postconviction relief, which included claims of ineffective assistance of counsel, unnecessary delay, improper sentencing, prosecutorial misconduct, and involuntary guilty plea, lacked substantive merit. NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED. BY THE COURT: /s/ Myron T. Steele Chief Justice
