IN THE SUPREME COURT OF THE STATE OF DELAWARE IN THE MATTER OF THE PETITION OF AHMED IFILL FOR A WRIT OF PROHIBITION AND/OR MANDAMUS § § No. 258, 2009 § § Submitted: May 20, 2009 Decided: July 13, 2009 Before BERGER, JACOBS, and RIDGELY, Justices. ORDER This 13th day of July 2009, upon consideration of the petition of Ahmed Ifill for an extraordinary writ of prohibition and/or mandamus, it appears to the Court that: (1) The petitioner, Ahmed Ifill, seeks to invoke the original jurisdiction of this Court to issue an extraordinary writ to compel the Superior Court to rule on his motion to dismiss his trial counsel and to delay his trial until it has ruled on his motion. The State of Delaware has filed a response and motion to dismiss Ifill s petition. (2) The Superior Court docket reflects that a jury trial was held in the Superior Court on June 4-5. Ifill is scheduled to be sentenced on July 17, 2009. His request to delay his trial until the Superior Court rules on a motion to dismiss counsel, therefore, is moot. NOW, THEREFORE, IT IS ORDERED that Ifill s petition for a writ of prohibition and/or mandamus is DISMISSED as moot. BY THE COURT: /s/ Jack B. Jacobs Justice -2-
