IN THE SUPREME COURT OF THE STATE OF DELAWARE IN THE MATTER OF THE PETITION OF KEVIN DIXON FOR A WRIT OF MANDAMUS § § No. 101, 2007 § Submitted: March 16, 2007 Decided: May 15, 2007 Before HOLLAND, JACOBS and RIDGELY, Justices ORDER This 15th day of May 2007, it appears to the Court that: (1) The petitioner, Kevin Dixon, seeks to invoke this Court s original jurisdiction to issue an extraordinary writ of mandamus1 to compel the Superior Court to provide him with copies of his court-ordered psychiatric/psychological evaluations so that he may pursue a postconviction motion. The State of Delaware, as the real party in interest, has filed an answer requesting that Dixon s petition be dismissed. (2) The petition filed by Dixon asserts claims identical to those contained in a petition for a writ of mandamus he filed in November 2006. By Order dated January 19, 2007, that petition was dismissed on the ground 1 Del. Const. art. IV, § 11(6); Supr. Ct. R. 43. that it manifestly failed to invoke the original jurisdiction of this Court.2 For that reason, Dixon s instant petition also must be dismissed.3 NOW, THEREFORE, IT IS ORDERED that the petition for a writ of mandamus is DISMISSED.
