IN THE SUPREME COURT OF THE STATE OF DELAWARE DONNIE O. WEAVER, Defendant BelowAppellant, v. STATE OF DELAWARE, Plaintiff BelowAppellee. § § § § § § § § § § § No. 413, 2002 Court Below Superior Court of the State of Delaware, in and for Sussex County Cr.A. No. S84-04-0052 through -0054 Cr. ID. 84002459DI Submitted: October 14, 2003 Decided: November 12, 2003 Before VEASEY, Chief Justice, HOLLAND, and JACOBS, Justices. ORDER This 12th day of November 2003, after careful consideration of the appellant s opening brief and the State s motion to affirm, we find it manifest that the judgment of the Superior Court should be affirmed on the basis of the Superior Court=s well-reasoned decision dated July 24, 2003. The Superior Court did not err in concluding that Weaver s motion for postconviction relief was time-barred and that Weaver had failed to overcome this procedural hurdle. NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED. BY THE COURT: /s/ E. Norman Veasey Chief Justice
