IN THE SUPREME COURT OF THE STATE OF DELAWARE SAMUEL L. ADAMS, Defendant BelowAppellant, v. STATE OF DELAWARE, Plaintiff BelowAppellee. § § § § § § § § § § § No. 537, 2001 Court Below Superior Court of the State of Delaware, in and for New Castle County Cr. ID Nos. 92007631DI and 92000865DI Submitted: March 4, 2002 Decided: March 19, 2002 Before VEASEY, Chief Justice, WALSH, and STEELE, Justices. ORDER This 19th day of March 2002, it appears to the Court that the defendant-appellant, Samuel Adams, filed this appeal on October 26, 2001 from the Superior Court s adjudication and sentence for Adams violation of probation (VOP). The record reflects that the Superior Court issued a modification of its VOP sentencing order on November 29, 2001. That order reflected that Adams Level V prison sentence was to be suspended immediately for time served and that no probation would follow. Accordingly, Adams is no longer under the supervision of the Department of Correction, and his appeal therefore is moot. NOW, THEREFORE, IT IS ORDERED that the Adams appeal is DISMISSED as moot. BY THE COURT: /s/ E. Norman Veasey Chief Justice -2-
