IN THE SUPREME COURT OF THE STATE OF DELAWARE IN THE MATTER OF THE PETITION FOR A WRIT OF MANDAMUS BY LAMONT K. HARRIGAN § § No. 286, 2000 § Submitted: June 20, 2000 Decided: August 15, 2000 Before VEASEY, Chief Justice, WALSH, and BERGER, Justices. ORDER This 15th day of August 2000, it appears to the Court that: (1) The petitioner, Lamont K. Harrigan, filed a petition for a writ of mandamus, pursuant to Supreme Court Rule 43, on June 12, 2000. Harrigan s petition requests that a writ of mandamus be issued to compel the Superior Court to rule on a petition for postconviction relief pending before that court. The State, as the real party in interest, has filed a motion to dismiss Harrigan s petition. (2) The State contends, and the Superior Court docket reflects, that the Superior Court denied Harrigan s postconviction petition on May 24, 2000. Consequently, Harrigan s petition for a writ of mandamus is moot. NOW, THEREFORE, IT IS ORDERED that the petition for a writ of mandamus is DISMISSED as moot.
