SUPERIOR COURT OF THE STATE OF DELAW ARE E. SCOTT BRADLEY SUSSEX CO UNT Y COU RTHO USE JUDGE 1 The Circle, Suite 2 GEORGETOWN, DE 19947 March 22, 2012 Michael W. Modica, Esquire Attorney at Law 715 N. King Street, Suite 300 P.O. Box 437 Wilmington, DE 19899 RE: Donald A. Bucklin, Esquire Department of Justice 114 East Market Street Georgetown, DE 19947 State of Delaware v. John M. Burkett Cr.A. No. S08-09-1057; S09-04-0250 - Def. ID No. 0809009398 Dear Counsel: I have denied the Defendant s Motion for Correction/Modification of Sentence. I remain satisfied that the original sentence is appropriate. As to the Defendant s assertion that his sentence was based, at least in part, on the fact that I allegedly concluded that he intended to drive the victim s business into bankruptcy, that is simply not the case. As the transcript of the sentencing indicates, my sentencing comments only reflect the fact that the Defendant s actions almost caused the victim s business to go into bankruptcy, not that is was his intention to do that. IT IS SO ORDERED. Very truly yours, /s/ E. Scott Bradley cc: Prothonotary s Office
