SUPERIOR COURT OF THE STATE OF DELAWARE T. HENLEY GRAVES SUSSEX COU NTY C OUR THO USE RESIDENT JUDGE ONE THE CIRCLE, SUITE 2 GEORGETOWN, DE 19947 July 10, 2009 Michael F. McGroerty, Esquire 110 Pine Street Seaford, DE 19973 RE: State v. Shaun Snow - Defendant ID No. 0807047572 Motion for Modification of Sentence Dear Mr. McGroerty: In response to your letter of June 29, 2009, I do not intend to micro-manage the Department of Correction. Your three page review of what may or may not have been an accountability issue is better determined by the Department of Correction. Your client is apparently in need of mental health counseling but has refused to cooperate with the Public Defender s Office by not signing a release so that information could be shared, and he has not cooperated with counselors within the Department of Correction. It is not appropriate for him to be rewarded for this conduct by modifying his sentence. Nor do I believe a person in his present circumstances is appropriate for Boot Camp. The bottom line is to the extent you request another modification of sentence, it is denied and your client should adopt a more accommodating attitude. IT IS SO ORDERED. Yours very truly, /s/ T.
