THE COURT.-

The opinion herein, filed July 8, 2002, appearing at 28 Cal. 4th 367, is modified as follows:

1. Delete the paragraph beginning at the bottom of page 379.

2. Replace section IV of the opinion with the following: "IV. [¶] For the foregoing reasons, we reverse the judgment of the Court of Appeal and remand the matter for further proceedings consistent with this decision."

This modification affects the judgment.
