The opinion herein, filed on August 9, 2001, appearing at 26 Cal. 4th 598, is modified as follows:

The second sentence of the last paragraph at the bottom of page 654 is revised to read:

Defendant testified that he was not drunk when he went to Jones's house.

This modification does not affect the judgment.
