No. BA065313-01 MODIFICATION OF OPINION THE COURT: The opinion herein, appearing at 49 Cal.4th 846, is modified as follows: In 49 Cal.4th at page 928, in the paragraph continued from page 927, delete the final sentence of that paragraph, reading: The fact that the jury was polled after the guilt phase verdict was announced and each juror individually affirmed the verdict also supports our conclusion that the trial court s actions did not improperly interfere with the jury s deliberations. This modification does not affect the judgment.
