IT IS ORDERED that the opinion filed herein May 15, 2002, be modified in the following particulars:

At page one, after the word "Reversed" insert the words "with direction."

At page 7, after the sentence concluding with the word "reversed" [98 Cal. App. 4th 483, advance report, line 12], insert the following sentence: "The trial court is directed to deny the petition for writ of mandate."

The foregoing modification does effect a change in judgment.
