It is ordered that the opinion filed herein on January 18, 2002, be modified in the following particulars:

On page 6, in the second full paragraph, add footnote 2 after the following sentence "So is the fact the sanctions motion filed was different from the one served." fn. 2

This modification does not effect a change in the judgment.
