Appellant's petition for rehearing is denied. The opinion filed herein on December 26, 2001 is modified as follows: In Part II of the Discussion, the last sentence of the second paragraph [94 Cal. App. 4th 1120, line 5] is changed to read:

"From the record on appeal, it appears Joshua never presented the trial court with the argument that Public Utilities Code section 2106 overrides section 846."

There is no change in judgment.
