It is ordered that the opinion filed herein on September 5, 2001, be modified as follows:

1. On page 27, the entire second full paragraph [92 Cal. App. 4th 104, advance report, 1st par.] is deleted, beginning "Finally, ATT's moving papers" and ending with the citation "(City of San Diego v. Rider (1996) 47 Cal. App. 4th 1473, 1493.)".

There is no change in judgment. Defendant and Appellant's petition for rehearing is denied.
