It is ordered that the opinion filed herein on May 16, 2001, certified for partial publication, be modified as follows:

1. On the ninth line from the bottom of page 15 [89 Cal. App. 4th 47, advance report, line 12], delete "(a)" and insert "(c)" in its place.

2. On the eighteenth line from the bottom of page 15[89 Cal. App. 4th 47, advance report, line 2], delete "custody" and insert in its place "conduct".

There is no change in the judgment.

The rehearing petitions are denied.
