WORK, Acting P.J.- Appellant's petition requesting modification (entitled petition for rehearing) has been reviewed.

The opinion, filed and certified for publication on April 27, 2000, is modified as follows:

1. At the end of the second paragraph of the introduction on page 2, [80 Cal. App. 4th 304, advance report, lines 7-8], in the sentence beginning "We also conclude . . . .," the word "dismissed" is replaced by the word "denied."

2. In the second full sentence on page 3 [80 Cal. App. 4th 304, advance report, 1st full par., line 8] beginning: "On August 26 . . . .", the date is changed to "August 22."

3. In the first paragraph under the Discussion heading on page 4, [80 Cal. App. 4th 305, advance report, line 2 (correction made in adv. Rep. Opn.)], the word "should" in the quote beginning "Any allowance or rejection . . . ." is changed to "shall."

4. In the fourth paragraph under heading III on page 8 [80 Cal. App. 4th 307, advance report, 1st full par., lines 1-3] beginning with: "Department cites two decisions it claims support its argument . . . .," the word "viability" is changed to "ability."

There is no change in the judgment.
