Surety American Contractors Indemnity appealed the entry of summary judgment in favor of El Dorado County following the forfeiture of a bail bond. American Contractors argued that the trial court entered judgment before the time for the defendant to appear had elapsed, therefore acted prematurely. Furthermore, the surety argued the trial court erred in denying the its motion to set aside on the grounds that it was filed too late. After review of the specific facts on record, the Court of Appeal agreed with the surety on both points. Accordingly, the Court vacated the summary judgment and exonerated the bond.
