In compliance with the direction of the Supreme Court of Alabama in Ex parte Walker, 623 So. 2d 281 (Ala.1992), the judgment of the circuit court is reversed and the cause remanded to the circuit court for proceedings consistent with the Supreme Court's opinion.

REVERSED AND REMANDED.
