As a m a t t e r o f f a c t , he e v e n a s k e d how t o s p e l l ' c o p s , ' ' c a t c h , ' and t h e n ' d a d d y . ' ... [ T . B . ] was v e r y up f r o n t a n d honest about [ Z . B . ] and [ J . B . ] d o i n g n a s t y t h i n g s . He s t a t e d t h a t [ Z . B . ] t r i e s t o do n a s t y t h i n g s w i t h h i m a t t i m e s , b u t he does n o t l e t h i m . He a l s o stated t h a t [ Z . B . ] and [ J . B . ] would look at pornography w h i l e a t [ t h e p a r e n t s ' house] He h a s seen [ J . B . ] and [ Z . B . ] a c t o u t n a s t y w i t h each o t h e r . When I a s k e d [ T . B . ] t o i n d i c a t e what ' n a s t y ' meant, he s a i d , ' Y o u know what men do t o g i r l s . B . ] i n d i c a t e d t h a t he saw i t on one o c c a s i o n a n d [ t h e f a t h e r , J.W.B.,] t o l d h i m t o l e a v e . The s e c o n d t i m e , [ t h e f a t h e r , J.W.B.,] a l l o w e d h i m t o s t a y a n d w a t c h t h e DVDs. ... He a l s o a d m i t s t o s e x u a l t a l k w i t h h i s b r o t h e r s a n d ' a c t i n g gay.' He was u n c l e a r a b o u t what t h a t a c t u a l l y m e a n t . " When M a l o n e was a s k e d w h e t h e r s h e b e l i e v e d t h a t e i t h e r J . B u t b a s e d on the a c t i o n s , t h e a c t i n g o u t t h e y o u know, t h e d e f e c a t i n g , t h e b e d w e t t i n g a n d t h o s e t h i n g s , when you have a m u l t i t u d e o f those and t h e c h i l d r e p o r t i n g s e x u a l i z e d b e h a v i o r s w i t h i n t h e home, y o u 12 then 2110550 a n d 2110568 k i n d o f go w i t h what n o t o n l y what t h e b e h a v i o r s a r e f o r s u r e , y o u know, b e c a u s e some o f t h e s i g n s o f s e x u a l abuse a r e t h e d e f e c a t i n g , t h e b e d w e t t i n g , the f i r e s t a r t i n g , the c r u e l t y t o animals, the excessive clothes, the hoarding, those kinds of t h i n g s , a g g r e s s i v e behavior. Code 1975. S e c t i o n 12-15-310, p r o v i d e s , i n pertinent part: " ( c ) A s t a t e m e n t made b y a c h i l d u n d e r t h e age o f 12 d e s c r i b i n g any a c t o f s e x u a l c o n d u c t p e r f o r m e d w i t h o r on t h e c h i l d b y a n o t h e r , not otherwise a d m i s s i b l e by s t a t u t e or court r u l e , i s a d m i s s i b l e i n a l l dependency cases b r o u g h t by t h e S t a t e o f Alabama a c t i n g by and t h r o u g h a l o c a l department o f human r e s o u r c e s i f : "(1) The s t a t e m e n t was made t o a s o c i a l w o r k e r , c h i l d s e x u a l abuse t h e r a p i s t or counselor, licensed psychologist, physician, or school or kindergarten teacher o r i n s t r u c t o r ; and "(2) The j u v e n i l e c o u r t f i n d s t h a t t h e time, c o n t e n t , and c i r c u m s t a n c e s of the statement provide sufficient i n d i c i a of r e l i a b i l i t y . Summers a p p o i n t e d the c h i l d r e n . t o a g r e e on t h e When t h e p a r t i e s c o u l d n o t a g r e e , Dr. Steven Bell Judge t o conduct e v a l u a t i o n s of Dr. B e l l d e c l i n e d t h e appointment and suggested t h a t t h e p a r t i e s c o n t a c t p s y c h o l o g i s t s a t t h e Sparks who a l s o d e c l i n e d t h e a p p o i n t m e n t . Clinic, Judge Summers s t a t e d t h a t he w o u l d c h o o s e a p s y c h o l o g i s t , b u t he n e v e r d i d so b e f o r e t h e cases were r e a s s i g n e d t o Judge 26 Storm.
