" I n c a r r y i n g o u t i t s m i s s i o n as a p u b l i c h o u s i n g authority, [t]he Authority acts as an i n s t r u m e n t a l i t y of the Department of Housing and U r b a n D e v e l o p m e n t (HUD) a n d a d m i n i s t e r s HUD p r o g r a m s which provide f e d e r a l payments or subsidies for low-income housing, including its conventional p u b l i c h o u s i n g p r o g r a m and i t s Section 8 voucher program. In administering these programs, [t]he A u t h o r i t y c o m p l i e s w i t h HUD r u l e s and regulations, Authority Application for Continued Occupancy Policies (ACOP), Administrative Plan, Lease A g r e e m e n t and a p p l i c a b l e s t a t e law. 3 to 2100653 "In i t s conventional housing program, [t]he A u t h o r i t y owns a n d o p e r a t e s 7 ( s e v e n ) p u b l i c h o u s i n g developments or projects. These are: George Washington Carver Homes (GWC), Felix Heights, Rangedale A p a r t m e n t s , Rangedale Annex, V a l l e y Creek Homes, M a g n o l i a C o u r t a n d W i l k i n s o n Homes. I n t h e s e developments, [ t ] h e A u t h o r i t y provides housing to 575 families totaling 1,326 i n d i v i d u a l s . In the operation of the S e c t i o n 8 voucher program, [ t ] h e Authority provides housing assistance to an additional 1,072 families totaling 2,625 i n d i v i d u a l s . The f u n d s u s e d by [ t ] h e A u t h o r i t y i n t h e o p e r a t i o n o f i t s c o n v e n t i o n a l p u b l i c h o u s i n g and S e c t i o n 8 voucher h o u s i n g programs are f e d e r a l funds and f u n d s g e n e r a t e d f r o m r e n t c o l l e c t i o n s . "In the o p e r a t i o n of i t s h o u s i n g developments, [t]he Authority employs resident and/or on-site m a n a g e r s . I t has b e e n t h e p o l i c y and p r a c t i c e o f [ t ] h e A u t h o r i t y f o r t h e s e managers to c o l l e c t t h a t p o r t i o n o f t h e r e n t p a y m e n t w h i c h may be due from t h e t e n a n t s and to report to [ t ] h e A u t h o r i t y the t e n a n t s who a r e d e l i n q u e n t i n t h e i r r e n t a l p a y m e n t s o r a r e i n v i o l a t i o n o f t h e l e a s e a g r e e m e n t . As an Executive Director of [t]he Authority and in p e r f o r m a n c e o f my management d u t i e s , I c a u s e d an u n l a w f u l d e t a i n e r c o m p l a i n t t o be p r e p a r e d a n d filed in the District Court of Dallas County against M i c h a e l W i l l i a m s , a r e s i d e n t o f ... GWC Homes, f o r r e a s o n o f n o n p a y m e n t o f r e n t . The complaint form u s e d i n t h e i n s t a n t c a s e i s t h e same o r s i m i l a r t o t h a t made a v a i l a b l e t o m e m b e r s o f t h e p u b l i c ( S t a t e of Alabama U n i f i e d J u d i c i a l System Form C-59). " I have r e v i e w e d r e c o r d s of [ t ] h e A u t h o r i t y f o r t h e p e r i o d J a n u a r y 2010 t o December 2010. During this period, [t]he Authority commenced 41 (forty-one) e v i c t i o n s i n the D a l l a s County D i s t r i c t C o u r t . L e g a l expenses a s s o c i a t e d w i t h the handling of the most r o u t i n e u n l a w f u l d e t a i n e r a c t i o n s are a m a t t e r of s u b s t a n t i v e concern to [ t ] h e Authority 4 2100653 which must carry out i t s mission within i t s b u d g e t a r y c o n f i n e s and r e s o u r c e s available to i t . "In i t s o p e r a t i o n s , [ t ] h e A u t h o r i t y i s always mindful of the r i g h t s of tenants a r i s i n g under s t a t e and f e d e r a l law and o f t h e o b l i g a t i o n s o f [ t ] h e A u t h o r i t y t o i t s t e n a n t s , i n c l u d i n g t h e r i g h t s and o b l i g a t i o n s which a r e s e t out i n the Alabama U n i f o r m R e s i d e n t i a l L a n d l o r d and Tenant A c t , s e t out i n A l a . Code [ 1 9 7 5 , ] S e c t i o n 35-9A-101, e t s e q . I n t h e instant case, [t]he Authority followed a l l provisions of the Alabama Uniform Residential L a n d l o r d and Tenant A c t w h i c h l e d t o t h e e n t r y o f a judgment against [ W i l l i a m s ] i n the D i s t r i c t Court of D a l l a s C o u n t y , A l a b a m a . To my k n o w l e d g e , t h e r e h a s b e e n no c l a i m t h a t [ t ] h e A u t h o r i t y v i o l a t e d a n y o f [ W i l l i a m s ' s ] r i g h t s o r d e n i e d t o him any o f t h e r i g h t s s e c u r e d by l a w , o t h e r than t h e a s s e r t i o n o f [ W i l l i a m s ' s ] attorney, Legal Services Corporation of Alabama, that the i n s t a n t u n l a w f u l d e t a i n e r action was not filed or prosecuted by a licensed attorney-at-law. Further, to the best of my knowledge, t h e p o s i t i o n taken by L e g a l Services Corporation of Alabama r e p r e s e n t s the consistent p o l i c y of Legal Services Corporation of Alabama t o o p p o s e t h e commencement of such a c t i o n s without representation of legal counsel even where non-payment o f r e n t i s u n d i s p u t e d and where t h e t e n a n t has r e c e i v e d a l l n o t i c e s r e q u i r e d by law. I t i s my f u r t h e r o p i n i o n t h a t t h i s p o l i c y i s u n f a i r a n d v i o l a t e s p u b l i c p o l i c y and t h e s p i r i t and i n t e n t o f the Alabama U n i f o r m R e s i d e n t i a l L a n d l o r d and Tenant A c t as s e t f o r t h i n t h e p u r p o s e s o f t h e A c t and which provide that the Act s h a l l be liberally construed a n d a p p l i e d t o : (1) s i m p l i f y , c l a r i f y , modernize, and r e v i s e t h e law g o v e r n i n g t h e r e n t a l of d w e l l i n g u n i t s and t h e r i g h t s and o b l i g a t i o n s o f l a n d l o r d s a n d t e n a n t s ; (2) e n c o u r a g e l a n d l o r d s a n d tenants to maintain and improve the q u a l i t y of h o u s i n g ; a n d (3) make u n i f o r m t h e l a w among t h o s e states which enact i t .
