51.5-94. Suspension of nominee; continued operation of program.

If the Department, after reasonable notice and opportunity for hearing to thenominee, finds that the nominee has failed to comply substantially with theprovisions of this article or the regulations issued thereunder, it shallnotify the nominee that its designation as nominee is suspended until theDepartment is satisfied that there will no longer be any such failure. Untilthe Department is so satisfied, or in the event the nominee shall cease toexist, the Department may make such provision as it deems proper for thecontinued operation of the program established under the provisions of thisarticle.
