51.5-39.12. Notification of critical incidents and deaths in statefacilities.

Notwithstanding any other provision of law, the directors of the statefacilities as defined in 37.2-100 shall notify the Director of the Officein writing within forty-eight hours of critical incidents or deaths ofpatients or residents in state facilities. For purposes of this section, acritical incident shall be defined as serious bodily injury or loss ofconsciousness requiring medical treatment. The Commissioner of the Departmentof Mental Health, Mental Retardation and Substance Abuse Services shallprovide to the Director of the Office a written report setting forth theknown facts of critical incidents or deaths of patients or residents offacilities within fifteen working days of the critical incident or death.
